Orange County Marriage License Requirements
The Clerk-Recorder marriage services page states clearly what every couple needs. Both people must appear together in person. Each person must show valid non-expired government-issued photo identification, such as a driver's license or passport. If divorced within the prior 90 days, the applicant must bring the decree. If a spouse died within the prior 90 days, the applicant must bring a certified death certificate. The license is signed at the office, and the couple selects the name each person wishes to use after marriage at that time.
The marriage services page hosts the rules and the appointment link.
Appointments are highly recommended and have priority. Walk-in service is available but slower.
Public vs Confidential Orange County Marriage License
California offers two license types and they are not the same record. A public marriage license becomes a public record, and anyone can request an informational copy. A confidential marriage license is confidential by statute, and only the couple may obtain information except by court order. The confidential license requires the couple to be living together before marriage. Both license types can be used anywhere in California.
| License Type | Fee | Public Record? | Requirements |
|---|---|---|---|
| Public marriage license | $61 | Yes; informational copy available | Photo ID; both present. |
| Confidential marriage license | $66 | Confidential by statute | Photo ID; both present; living together. |

Ceremony fees are charged separately when performed by a County Deputy Clerk. The current Clerk-Recorder is Hugh Nguyen; the office runs branch offices in Anaheim, Laguna Hills, and Santa Ana.

Orange County Ceremony Rules
Ceremony rooms at the Clerk-Recorder are for Clerk-Recorder customers only. Ceremonies in those rooms are performed only by County Deputy Clerks; outside officiants do not perform ceremonies in those rooms. For a public marriage license ceremony at a Clerk-Recorder location, the couple must provide at least one witness. The witness must physically witness the ceremony and sign the public license. The department will not provide witnesses.
Both individuals must be able to read, speak, and understand English. If not, they must bring a sole witness able to translate for both license and ceremony. The department does not provide translation services or witnesses. The Old County Courthouse hosts wedding events through OC Parks for couples that want a historic civic venue.

Orange County Divorce Records in Superior Court
Divorce and dissolution cases are Superior Court family law matters, not Clerk-Recorder records. Use the Family Law Case Access portal at fampub.occourts.org for case-level information. Remote document access for family law is restricted. For a certified dissolution copy, use the court's records process; the fee is $15 for most applicants and $10 for a public agency under Government Code § 70674.
California is a no-fault divorce state. A spouse does not have to prove wrongdoing. Residency rules require one spouse to have lived in California for at least six months and in Orange County for at least three months before filing. Summary dissolution is available for shorter marriages under specific conditions.
